Terms of Use

These Terms of Use (“Terms”) govern your use of the Courtify iOS app and the website at courtify.xyz (together, the “Service”). By downloading, accessing, or using Courtify, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Courtify provides tennis-related information and widgets for iPhone, including rankings, schedules, countdowns, live scores where available, and related features. Some features are free; others require a paid Premium subscription.

Tennis data is provided for personal, non-commercial use and may be delayed, incomplete, or unavailable. Courtify is not affiliated with the ATP, WTA, ITF, or any Grand Slam tournament unless expressly stated.

2. Eligibility

You must be able to form a binding contract in your jurisdiction to use Courtify. If you use Courtify on behalf of an organization, you represent that you have authority to bind that organization.

3. Accounts & Apple ID

Courtify does not require a separate Courtify account. Purchases and subscriptions are tied to your Apple ID and processed by Apple. You are responsible for activity under your Apple ID related to Courtify.

4. Subscriptions & payments

Premium access is offered through auto-renewable In-App Subscriptions via the App Store. Prices, plans, and trial or introductory offers (if any) are shown in the app and on the App Store product page at the time of purchase.

Payment is charged to your Apple ID account at confirmation of purchase.
Subscriptions automatically renew unless you turn off auto-renew at least 24 hours before the end of the current period.
Your account will be charged for renewal within 24 hours prior to the end of the current period at the then-applicable rate.
You can manage or cancel subscriptions in your Apple ID account settings after purchase (Apple’s subscription help).
Any unused portion of a free trial, if offered, is forfeited when you purchase a subscription where applicable.

Refunds are handled by Apple under Apple’s refund policies. We cannot directly refund App Store purchases.

5. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use Courtify for personal, non-commercial purposes on Apple devices you own or control, subject to these Terms and the Apple Licensed Application End User License Agreement (or the custom EULA we publish, if any).

You may not copy, modify, distribute, reverse engineer, or create derivative works of the Service except as allowed by law.

6. Acceptable use

You agree not to:

Misuse the Service, attempt to disrupt our servers, or circumvent access controls
Scrape, bulk-download, or redistribute tennis data from Courtify for commercial use
Use Courtify in any way that violates applicable law or third-party rights

7. Intellectual property

Courtify, including its design, branding, software, and content we create, is owned by us or our licensors. Player names, likenesses, tournament marks, and third-party logos remain the property of their respective owners and are used for informational and referential purposes.

8. Disclaimer

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that scores, rankings, or schedules will be accurate, complete, or uninterrupted.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, COURTIFY AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, PROFITS, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US FOR COURTIFY PREMIUM IN THE 12 MONTHS BEFORE THE CLAIM OR (B) USD $50.

10. Privacy

Our Privacy Policy explains how we collect and use information. By using Courtify, you also acknowledge that policy.

11. Changes & termination

We may update these Terms or modify the Service at any time. Continued use after changes means you accept the updated Terms. We may suspend or stop providing the Service, including for maintenance, abuse, or legal reasons.

12. Governing law

These Terms are governed by the laws of the State of New York, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence provide otherwise.

14. Apple-specific terms

You acknowledge that these Terms are between you and Courtify only, not Apple. Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support for Courtify. In the event of any failure of Courtify to conform to an applicable warranty, you may notify Apple, and Apple may refund the purchase price for the app (if any); to the maximum extent permitted by law, Apple has no other warranty obligation. Apple is not responsible for addressing claims relating to Courtify or your possession/use of it, including product liability, legal/regulatory claims, or consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.
